Bilateral trade between China and Africa has developed rapidly in recent years.Since 2009, China has been Africa's largest trading partner for 10 consecutive years.ln his keynote speech at the opening ceremony of 2018 Beijing Summit of Forum on China-Africa Cooperation (FOCAC), President Xi Jinping made it clear that the building of the Belt and Road Initiative should align with the development strategies of African countries and build a closer China-Africa community with a shared future. To this end,he proposed that China should work closely with African countries in the next 3 years and beyond to implement the Eight Major Initiatives. These cover the following 8 areas:industry promotion, infrastructure connectivity, trade facilitation, green develop-ment, capacity building, health, people-to-people exchanges and peace and security. The implementation of the Eight Major Initiatives will bring a rare historic opportunity for the development of China-Africa economic and trade relations. With the development of investment and trade between China and Africa and the further strengthening of cultural and people-to-people exchanges between China and Africa, there are bound to be a large number of economic,trade and investment disputes,civil and commercial disputes and various criminal cases between China and Africa . It is proposed in the Initiatives adopted at previous FOCAC that China and Africa should negotiate and sign more bilateral treaties on investment and judicial assistance in the field of legislation,justice and law enforcement.But, with the rapid development of China-Africa economy, trade, investment and cultural exchanges, the current legal construction is still lagging behind and can't provide effective legal guarantee for bilateral exchanges and cooperation.

朱偉東,河南省汝南縣人,法學博士,中國非洲研究院、中國社會科學院西亞非洲研究所研究員、博士生導師,中國社會科學院首屆領軍人才。自2008年起,他先后在劍橋大學法學院進行博士后研究,在首爾國立大學法學院任訪問研究員;曾被評為湖南省青年骨干教師、湖南省121人才工程第三層次人選、國務院政府特殊津貼專家。朱偉東在國內外出版社出版非洲法方面的專著、譯著8部,在《西亞非洲》、Journal of African Law, Penant, Journal of South African Law, Journal of Private International Law, Yearbook of Private International Law, Journal of International Arbitration等國內外報刊發(fā)表各類文章200多篇。他還主持非洲法方面的國家社科課題3項,外交部中非聯(lián)合計劃課題2項;他還是中國國際私法學會常務理事,中國民族法學研究會理事,中國非洲史學會理事,中國亞非學會理事,英國Cambridge Journal of China Studies雜志編委,南非Journal of Law, Society and Development雜志國際顧問委員會委員,南部非洲仲裁基金(南非)、上海國際仲裁中心等國內外多家仲裁機構仲裁員,兼職律師。王瓊,女,河南商丘人。中國人民大學法學院法學博士,中國社會科學院法學研究所法學博士后?,F(xiàn)為中國非洲研究院、中國社會科學院西亞非洲研究所副研究員,從事中東非洲政治、中東非洲法律、中東非洲熱點問題與國際法研究。在《中國司法》《人民司法》《法學雜志》《人民論壇》《西亞非洲》《阿拉伯世界研究》《學術探索》《當代世界》等學術期刊上發(fā)表論文60多篇。她已出版?zhèn)€人專著、合著多部。主要著作有:《西亞非洲法制》(法律出版社2013年版)、《罰金刑實證研究》(法律出版社2009年版)、《法官自由裁量權之法理分析》(2012年版,合著)。此外,她還任北京交通大學重組與兼并研究中心研究員,中國—中東法律研究中心研究員等,并從事兼職律師工作。王婷,女,海南省??谑腥?,2014年和2017年先后在北京工商大學獲得文學學士學位和法學碩士學位,目前在中國社會科學院研究生院攻讀法學博士學位。王婷的主要研究方向是非洲法、非洲國際關系,已在《現(xiàn)代管理科學》《國際商報》和Cambridge Journal of Chinese Study等國內外報刊發(fā)表中英文論文、譯文、時評短文數(shù)篇,另有論文和譯文擬被《西亞非洲》《非洲法評論》和《國際法與比較法論叢》采用,參與中國非洲研究院中非聯(lián)合項目課題(“中非經貿關系可持續(xù)發(fā)展的法律保障研究”)和國家社科基金研究專項課題(“非洲本土化立法研究”)兩項。
